Conditions of sale
Subject
The subject of these general conditions is the online purchase of products on the website “orodispello.it” (hereinafter also the “Website”), owned by Anfatis Centro S.p.a., based in Via Liborio Coccetti, 8 – 06034 Foligno (PG). Purchase is reserved for customers who are direct users (hereinafter also “Customers“), thus excluding any persons with the intention of selling relative products to third parties.
Any purchase transactions will be regulated by provisions set forth in Legislative Decree no. 206 of 6th September 2005 (“Consumer Code“) and in particular, regulations under part III, Title II, Section II (“Distance Contracts“) of said regulatory provision; the protection of personal data confidentiality is regulated by EU Regulation no. 679, 27th April 2016 (the “GDPR”).
Acceptance of general conditions of sale
The Customer, with the electronic sending of the purchase order, unconditionally accepts and commits to complying with the general conditions of sale and payment described here below, in all interactions with Anfatis Centro S.p.a.; they also declare to have read and accept them and acknowledge that any derogation or integration to said general conditions of sale and payment must be recorded in a written document previously accepted by the party concerned, addressing said derogation or integration.
Purchase method and shipment costs
The website orodispello.it is a website for the sale of bio-dermacosmetic products characterised by the presence of Extra Virgin Olive Oil (hereinafter also “Products“). Purchases of products, available as illustrated and described online in relative descriptive sheets, are made by the Customer according to the price on the Website, upon order confirmation, to which transport costs are added, as specified on the Website (“calculation of shipment”) and displayed when the purchase is made.
A shipment fee of 3 Euros is charged for deliveries to Italy; no shipment fee is charged for purchases of over 60 Euros.
Before the Customer confirms their purchase, the unitary cost of each selected item will be listed, along with the total cost, if the order includes several Products, and relative shipment costs. When the purchase is confirmed and once the transaction is completed, the Customer will receive an email containing the date, total amount and details of their order. During the purchase procedure, if it is not possible to order a Product as it is out of stock, the Customer will be notified by email and/or phone. Anfatis Centro S.p.a will not be held liable under any circumstances by the Customer for the unavailability of Products.
Moreover, it is hereby specified that any agreed promotions in the form of a promotional code are exclusively valid for a single order, for a specific period of validity, and are not cumulative with other discounts and/or offers.
Deliveries will not be made to the following: Switzerland, Livigno, Campione d’Italia, Vatican City, Republic of San Marino, United Kingdom (UK); we recommend you contact vendite@orodispello.it.
Anfatis Centro S.p.a will not be held liable under any circumstances for any errors caused by the Customer’s faulty connection to the website orodispello.it.
Payments
The payment of purchased Products and relative shipment costs must be borne by the Customer upon order confirmation, by:
- credit cards: Visa, Master Card;
- PayPal
- MyBank immediate bank transfer
- Bank transfer
- Cash upon delivery (Italy only)
User data are encrypted using the SSL (Secur Socket Layer) system, directly on the Bank server, which guarantees the security of data transmission, in accordance with bank procedures in force.
If for any reason whatsoever funds covering the purchase order are not received within 5 (five) working days from the date on which the order was placed, contractual execution will not be possible and the order will be considered cancelled.
Products
The graphic representation of products on the Website may differ from reality, therefore the Customer should exclusively refer to the Product description and characteristics on the Website. Anfatis Centro S.p.a reserves the right to limit the quantity and/or type of Products available for purchase on the Website, at any time. The style, models, colours and prices of Products described and listed on the Website may be modified by the Seller without notice.
Product delivery
Purchased products will be delivered by Anfatis Centro S.p.a. to the address provided by the Customer. Deliveries of purchased Products will take place on all working days. Couriers will not phone in advance and will not process requests for shipments at special times. Goods will be delivered by Anfatis Centro S.p.a. to the courier within 48 hours, from the first working day after the date of order reception approximately, subject to product availability and any causes of force majeure, without this constituting an obligation for Anfatis Centro S.p.a.. Approximate shipment delivery times are as follows: express courier (delivery to Italy only): 2/3 working days; international courier: 3-4 working days in major European cities. For deliveries beyond Italy, fees will be automatically calculated by the program. Parcels are sealed with Anfatis Centro S.p.a. adhesive tape.
Delivery times may vary and delays may be experienced in the event of intense shipment traffic, such as on the run up to festivities.
The Customer is required to check the parcel is intact and undamaged. The Customer should only accept delivery after checking the parcel. Once the delivery is accepted, the Customer will not be able to submit any claim to Anfatis Centro S.p.a. regarding the exterior characteristics of what is delivered, in relation to the order placed. If there is a discrepancy between the order and delivered goods, the Customer will be required to report it directly to the carrier by sending an email through the Website, in accordance with procedures specified herein.
Warranty for Product defects
Products purchased through the Website orodispello.it are subject to the provisions set forth in Legislative Decree no. 206, 6th September 2005 (Consumer Code), concerning purchase and consumption processes, if applicable; if not contemplated therein, they are subject to other specific provisions set forth in the Civil Code and legislation in force. The warranty required by applicable legislation will apply to the Product presenting latent flaws that cannot be noticed upon purchase, on the condition that the Product is used correctly and with due diligence, therefore according to intended use and the description, in compliance with provided instructions. The aforementioned warranty shall not apply in the event of negligence, negligent use and storage of the Product by the Customer. The warranty is personal and therefore will only apply to the original purchaser, insofar as reserved to direct customers and not traders, retailers, etc. Any Product faults/ defects must be reported within 7 (seven) days from Product reception, under penalty of expiration. The written report must be enclosed with the package containing the faulty Product, which the Customer will return to Anfatis Centro S.p.a.
Anfatis Centro S.p.a. reserves the right to verify the veracity of the defect reported by the Customer and to proceed with replacement only after carrying out such a check. The request will only be processed if the returned parcel contains the following documents: purchase invoice, order number and date, a short description of the detected fault or defect. Costs for returning the Product to Anfatis Centro S.p.a. will be borne by the Customer. Before sending the Product deemed faulty or defective, the Customer must use the “contact” form to describe the nature of goods and the defect or fault. They will then receive all the information required to use the warranty. Failure to comply with this procedure may significantly lengthen replacement times.
If the purchase was made using a discount code, only the actual amount spent will be refunded.
Right to withdrawal
Purchases made on the Website orodispello.it are regulated by Italian legislation governing contracts concluded at a distance. The Customer, pursuant to art. 64, Legislative Decree no. 206, 6th September 2005 (Consumer Code), has the right to exercise the right of withdrawal from the sale contract concluded, within the deadline of 7 (seven) working days from the date on which the purchased Product (or purchased products) was delivered. Under such circumstances, they are required to return the Product (or Products) to Anfatis Centro S.p.a. at their own care and expense and within 10 (ten) days, if the Customer resides in the territory of a State other than Italy.
Under said circumstances, Anfatis Centro S.p.a. shall accept and refund the full amount (excluding packaging and shipment costs, as provided for by Italian Legislation) – the return of any Product, on the condition that it is in perfect condition and complete with its intact packaging. In the parcel containing the goods to be returned, which must be correctly packaged, a copy of the delivery note must be enclosed and said package must be sent to the following address: Anfatis Centro S.p.a., Via Liborio Coccetti, 8 – 06034 Foligno (PG) – Italy
Privacy
Personal Data which the Customer has provided and will provide for the duration of relations are and will be processed in accordance with the privacy information statement, with the purpose of fulfilling obligations set forth in the sale contract entered into with the Customer, and to fulfil consequent obligations established by legislation, regulations and orders issued by Administrative or Judicial Authorities. The Customer’s Personal Data are processed for promotional and advertising purposes, subject to the Customer’s explicit and prior consent, by “clicking” on the specific box in the registration form.

Jurisdiction and Competent Court
This contract is governed by Italian law. For any dispute arising as to the validity, interpretation or execution thereof, the judge of the place of the Customer’s/ consumer’s residence or domicile shall hold territorial competency, if the place of residence or domicile is in the territory of the Italian Republic.
Should a dispute arise involving Customers/consumers who are residents or domiciled in the territory of a European Union Member State other than Italy: (a) for disputes initiated by the Customer/consumer, the jurisdiction and territorial competence, as an alternative and subject to the Customer’s/consumer’s choice, can be where Anfatis Centro S.p.a. is based or the place of the Customer’s/ consumer’s residence or domicile, whereas b) for disputes initiated by Anfatis Centro S.p.a., the place of the Customer’s/consumer’s residence or domicile will hold jurisdiction and territorial competence.
The cancellation of orders by Anfatis Centro S.p.a.
Anfatis Centro S.p.a. reserves the right to withdraw, void or cancel an order or Product entered in an order, under any of the following circumstances:
- Should suppliers of Anfatis Centro S.p.a. be unable to deliver the Product, or should delivery difficulties mean that Anfatis Centro S.p.a. is unable to execute the order in accordance with the times and methods agreed with the Customer. By way of example but not of limitation, cases of inability to deliver or difficulty in executing deliveries also include: (a) a lack of raw materials necessary for the production of products or difficulty in procuring such materials; (b) destruction, damage or loss of products, product stocks, or essential parts (including packaging) due to fortuitous circumstances, force majeure or due to third party fault.
- The occurrence of credit card fraud, also by third parties, which can jeopardise the security of Customer payment transactions.
- The occurrence of fraud to the detriment of Anfatis Centro S.p.a. through the Website, also by third parties, which poses a threat to contractual execution.
